Clarins Fined for Price Fixing
PARIS — Clarins SA has been fined 500,000 euros, or $650,580 at current exchange rates, by France's competition watchdog for fixing retail prices.
The Clarins ruling comes almost one year after 13 prestige beauty brands owned by LVMH Moët Hennessy Louis Vuitton, L'Oréal and Chanel, plus France's three leading selective perfumery retailers, Marionnaud Parfumeries, Sephora and Nocibe, were fined a combined 46.2 million euros, or $60.1 million, by le Conseil de la Concurrence (the Competition Council) for fixing retail prices between 1997 and 2000, as reported.
Under European law, retailers are free to choose their own in-store prices to encourage competition. Suppliers can suggest — but not impose — the price level at which their products are sold.
But in March 2006, the watchdog found that "between 1997 and 2000, companies manufacturing fragrance and cosmetics brands had agreements with the channel's distributors, notably national chains Marionnaud, Nocibe and Sephora, to eliminate competition among retailers selling their products."
This verdict involves Clarins alone because last March the council had decided not to include Clarins France in the broader decision, but to defer a verdict pending further investigation. This fine is the result. |
